1. About these Terms
These Terms & Conditions (“Terms”) govern the relationship between LITKRAFT LTD (“LITKRAFT”, “we”, “us” or “our”) and any person who uses our website litkraft.co.uk (the “Site”), contacts us, or instructs us to assist with a personal injury or other claim (a “Claim”).
By using the Site or by instructing LITKRAFT, you confirm that you have read, understood and agree to these Terms. If you do not agree, please do not use the Site or our services.
The information on the Site is general in nature, based on the law of England and Wales. Laws and regulations may differ outside England and Wales, and the information should not be relied upon as legal advice.
2. About LITKRAFT
LITKRAFT LTD is a private limited company registered in England and Wales under company number 07855435, with its registered office at:
Atlantic Business Centre, 1 The Green, Chingford, London E4 7ES, United Kingdom
- VAT number: 156247601
- Telephone: 0208 635 5555
- Email: help@litkraft.co.uk
LITKRAFT is a Claims Management Company (CMC) authorised and regulated by the Financial Conduct Authority (FCA No. 836796) for regulated claims management activities. We are also registered with the Information Commissioner’s Office (ICO).
3. Our Services
3.1 LITKRAFT is a claims management company. We do not provide legal advice and we are not a firm of solicitors. Our role is to:
- listen to the details of your accident or incident;
- assess, on a preliminary basis, whether you may have a Claim;
- where appropriate, refer you to an independent firm of solicitors from our panel that specialises in personal injury or related claims; and
- support you with translation and communication in your preferred language.
3.2 Our advisors are available 24/7 and consultations are free of charge and without obligation. We may visit you at home, in hospital or in any other suitable location in the United Kingdom.
3.3 If we feel we cannot assist you, we will tell you so and you remain free to seek advice elsewhere.
4. No Legal Advice
The contents of the Site, including any articles, blog posts, videos, FAQs and the personal injury compensation calculator, are provided for general information only and do not constitute legal advice. You should always consult a qualified solicitor regarding any specific legal issue. Outcomes and compensation amounts vary depending on the facts of each case, and we cannot guarantee the result of any Claim.
5. Panel of Solicitors
5.1 LITKRAFT works with a panel of independent firms of solicitors that specialise in personal injury, medical negligence, housing disrepair and related claims, including firms recognised by Legal 500. Where appropriate, we will introduce you to a panel firm that we consider suitable for your matter.
5.2 You are free to choose any solicitor you wish. You are not obliged to use a panel firm we recommend. If a panel firm is unable or unwilling to take your matter forward, we may, with your consent, refer you to another firm on our panel.
5.3 Any solicitor we introduce you to is an independent professional from whom you should receive impartial and confidential legal advice. They are required to comply with the Solicitors’ Code of Conduct and act in your best interests.
5.4 LITKRAFT is not responsible for the legal advice or other work undertaken on your behalf by panel solicitor firms. The panel firm will provide their own client-care information, terms and complaints procedure, and will give you independent advice on matters such as legal expenses insurance and medico-legal reporting.
6. Fees and Payments
6.1 No charge from LITKRAFT
LITKRAFT will not charge you any fee for our claims management services. We will not ask you to take out any loan, enter into any contract, or sign anything in order to use our service.
6.2 Referral fees
LITKRAFT receives a referral fee or marketing payment from the panel solicitor firm for introducing your matter. This payment is made by the solicitor firm out of its own resources and does not affect any compensation that may be awarded to you, nor does it increase the success fee charged to you by the solicitor.
6.3 Solicitor fees — “No Win, No Fee”
Panel solicitor firms typically work under a Conditional Fee Agreement (a “No Win, No Fee” agreement). This generally means:
- if your Claim is unsuccessful, you usually pay no legal fees to the solicitor (subject to the terms of the agreement and any insurance arrangements);
- if your Claim succeeds, the solicitor will deduct a success fee, typically up to 25% of the compensation recovered (excluding any future-care or other ring-fenced damages, as set out in the agreement);
- the solicitor may charge a cancellation fee if you end the agreement early without good reason.
The panel firm will provide you with full written details of their Conditional Fee Agreement, including all fees, deductions and cancellation terms, before you sign.
7. Your Information and Co-operation
7.1 In order for us and the panel firm to assess and progress your Claim, you agree to:
- provide accurate, truthful and complete information about your accident or incident;
- promptly inform us of any change in your contact details, circumstances, employment or medical condition;
- co-operate with reasonable requests for information, documents, medical examinations and statements; and
- not use our services for any fraudulent, dishonest or unlawful purpose.
7.2 LITKRAFT may verify the information you provide for fraud-prevention and compliance purposes. We may decline to take a matter forward if we suspect dishonesty or fraud.
8. Tracking Case Outcomes
To help us improve the quality of our service, we ask panel solicitor firms to provide brief details of the progress and outcome of your Claim. This information is treated confidentially. If you do not wish the solicitor to share progress information with us, please instruct them accordingly.
9. Cancellation and Termination
9.1 You may cancel your instructions to LITKRAFT at any time, free of charge, by contacting us by phone, email or in writing.
9.2 If you have entered into a Conditional Fee Agreement directly with a panel solicitor firm, your right to cancel that agreement and any cancellation fees are governed by the terms of that agreement and applicable consumer law.
9.3 LITKRAFT may decline or stop assisting you if:
- we believe we are unable to help with your matter;
- you provide false, misleading or incomplete information;
- you behave abusively or threateningly towards our staff; or
- continuing to assist you would breach any law, regulation or our regulatory obligations.
