LITKRAFT is authorised and regulated by the Financial Conduct Authority (FCA No. 836796) and is registered with the Information Commissioner’s Office (ICO).
For the purposes of UK data protection law (the UK GDPR and the Data Protection Act 2018) and the EU General Data Protection Regulation (Regulation (EU) 2016/679) where applicable, we are the data controller of your personal data.

2. Visitors to Our Website
2.1 What we collect

- 2.1.2 Whenever you provide information when reporting a problem with our Site, making a complaint, making an enquiry, or contacting us by telephone, email or any other channel — we may keep a record of that correspondence;
- 2.1.3 Details of your visits to our Site including, without limitation, traffic data, location data, weblogs, device data and other communication data, and the pages you access (see section 2.2 below); and
- 2.1.4 Whenever you otherwise disclose information to us through our Site (for example, by uploading documents).
2.2 How we collect it
IP address and device data. We may collect information about your device, including (where available) your IP address, operating system and browser type, for fraud prevention, system administration and aggregate analytics. This is statistical data about our users’ browsing actions and patterns and does not identify any individual.
Cookies. Our Site uses cookies to distinguish you from other users, to provide you with a good experience and to improve the Site. For detailed information about the cookies we use, see section 13 below.
2.3 How we use it
We may use your personal data on the basis of our legitimate interests in order to:

3. Customers and Claimants
3.1 When you enquire about our services, we (and the third-party organisations we appoint to deal with your enquiry) may collect details such as your name, contact details, date of birth and, depending upon the nature of your enquiry, details such as your vehicle registration number, employer’s contact details and/or medical information. We will use this information to assess your claim and, if we accept it, to deliver our services to you.
3.2 We also collect your contact details when you complete one of our online enquiry forms and use this information to contact you and follow up on your enquiry.
3.3 In order to provide you with the services you have requested, we may share personal data with third parties such as:
- our panel solicitors instructed to handle your claim;
- medical agencies, experts and rehabilitation providers;
- insurance companies, brokers and credit-hire companies;
- translation and interpreting providers; and
- other business partners (instructed by us or our panel solicitors) involved in delivering the services you have requested.
3.4 We may, with your prior consent where required, publish your feedback or testimonial on our website and marketing materials.
3.5 We will retain your information for as long as we need it to provide our services and for 6 years afterwards, unless a longer period is required by law or regulation. Where you have subscribed to receive marketing, we will retain your data for the period set out in section 5.
4. If You Fail to Provide Personal Data
Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide our services). In that case, we may have to decline or cancel a service, but we will notify you at the time.
5. Marketing
5.1 In addition to the uses described in sections 2–4 above, where you have indicated that you would like to receive marketing communications, subscribed to our marketing lists or newsletters, or provided us with your details at events, we may use your personal data on the basis of our legitimate interests to provide you with details of services we think may interest you.
5.2 You have the right to opt out of receiving marketing at any time. To opt out, you can:

- 5.2.2 contact us using the details in section 14.
5.3 Where you have subscribed to receive marketing from us we will keep your personal data for 6 years from the date you provided your consent, unless you withdraw consent earlier.
6. Monitoring and Recording
We may monitor and record communications with you (such as telephone calls and emails) for the purposes of quality assurance, training, fraud prevention and regulatory compliance. We also operate CCTV at our premises for the purposes of crime prevention and health and safety. We retain such recordings for 6 years.
7. Automated Processing
7.1 In certain situations we may use personal data to make automated decisions to improve our business — for example, using your geographical location to present locally relevant marketing.
7.2 You have the right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects on you. We will not use such automated processing in connection with your claim itself.
8. Legal Basis for Processing
We will only use your personal data where the law allows us to. The legal bases we rely on are:
- 8.1.1 Performance of a contract with you (for example, to deliver the claims-management services you have requested);
- 8.1.2 Compliance with a legal or regulatory obligation (for example, FCA, anti-money-laundering or court rules);
- 8.1.3 Our legitimate interests (for example, to operate, improve and market our services), provided your interests and fundamental rights do not override those interests; and
- 8.1.4 Your consent, where we specifically ask for it (for example, for certain marketing or special category data).
Where we process special category data (for example, health information relating to your accident), we rely on Article 9(2)(f) UK GDPR (establishment, exercise or defence of legal claims) or your explicit consent.
9. Disclosure of Personal Data to Third Parties
9.1 In addition to the third parties mentioned above, we may share your information with:
- 9.1.1 third-party agencies that assist us with marketing;
- 9.1.2 third-party agencies that conduct customer-experience surveys on our behalf;

9.2 We may disclose personal data to the police, regulatory bodies, legal advisors or similar third parties where we are under a legal duty to disclose, or in order to enforce or apply our website terms or other agreements, or to protect the rights, property or safety of our customers, ourselves or others. This includes exchanging information with other companies and organisations for fraud-prevention and credit-risk purposes.
9.3 We will not sell or distribute your personal data to other organisations for their own marketing without your consent.
10. Where We Store Your Information

- 11.2.1 access the personal data we hold about you and receive a copy in an intelligible form;
- 11.2.2 rectify inaccurate or incomplete data;
- 11.2.3 erase your personal data (the “right to be forgotten”);

- 11.2.5 object to processing based on our legitimate interests or for direct marketing;
